Avoidance of probate is not necessarily the ultimate goal in estate planning. There are some things, that even under the best-crafted procedures, will require probate. There are also reasons why probate can be beneficial: too many people get scared away from probate; you should speak with your attorney about what the real costs are associated with probate before you go through a bunch of procedures in order to try and avoid it. Remember there that probate is a procedure that has been around for hundreds of years, it is time-tested, it is a procedure that the courts are used to and there is oversight provided by the court. Those are all important things for you to consider.
